Terms of Service

Effective October 2, 2026. These terms govern use of this website and drone data services provided by Colorado Drone ("we," "us").

Use of this website

This website is provided for the purpose of describing our services and allowing prospective clients to request a quote or consultation. You agree not to misuse the site, attempt to disrupt it, or submit false information through the contact form.

Service engagements

Any drone data services — progress monitoring, aerial photography/video, mapping, orthomosaics, 3D modeling, or volumetric measurement — are governed by a separate written agreement, quote, or statement of work between Colorado Drone and the client once scope, cadence, pricing, and deliverables are confirmed. These Terms apply generally to that engagement unless the written agreement says otherwise.

FAA compliance & flight operations

Colorado Drone operates under FAA Part 107 and flies only within applicable federal, state, and local airspace regulations. We determine flight feasibility — including airspace authorization, weather, and site conditions — at our sole discretion and may reschedule or decline a flight for safety or regulatory reasons without liability for resulting delay.

Site access & client responsibilities

To fly a scheduled job, the client agrees to:

  • Provide safe, lawful access to the site and disclose known hazards (cranes, overhead lines, restricted areas, people/equipment in the flight zone)
  • Obtain any property-owner or site-specific permissions needed for us to operate
  • Communicate scheduling conflicts or site changes with reasonable notice

Deliverables & turnaround

Estimated turnaround times (such as the 48-hour benchmark referenced on this site) are typical, not guaranteed, and may vary based on job complexity, weather delays, or processing volume. Deliverables are provided in the format specified in the applicable quote or agreement.

Payment & cancellation

Invoices are due within 30 days of the invoice date unless the client's quote or service agreement states otherwise. Clients must give at least 24 hours' notice to cancel or reschedule a scheduled flight.

Intellectual property & usage rights

Unless otherwise agreed in writing, Colorado Drone retains ownership of raw aerial imagery and underlying data. Clients receive a license to use delivered photos, video, maps, models, and reports for their internal, marketing, leasing, and reporting purposes related to the project. Colorado Drone may use delivered work in its own portfolio and marketing materials unless the client requests confidentiality in writing.

Liability

To the fullest extent permitted by law, Colorado Drone's liability for any claim arising from our services is limited to the amount paid for the specific flight or deliverable giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, or for delays caused by weather, airspace restrictions, or site conditions outside our control.

Insurance

Colorado Drone maintains $2,000,000 in commercial drone liability insurance. Certificates of insurance are available on request.

Indemnification

The client agrees to indemnify Colorado Drone against claims arising from inaccurate site information provided by the client, undisclosed hazards, or the client's misuse of delivered data.

Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Changes to these terms

We may update these Terms from time to time. The effective date above reflects the most recent revision.
